I chatted with a business colleague about this. Her up-beat slant was, “Look at it this way — Imitation is considered the highest form of flattery”.

So, I decided to put my thoughts into a blog and this is what I’ve come up with.
Imitating my Kinkassage® trademark implies an aim to ride on my business coattails and success.
It undermines those who invested money to become Kinkassage bodyworkers.
This imitator lacks creativity, opting for an unoriginal business approach instead of embracing innovative thinking.

Earlier this week, a competitor within the adult erotic massage industry went ahead and replicated my registered trademark, Kinkassage®, using the term Kink-assage. The discovery left me utterly gobsmacked, especially upon discovering their SEO copy prominently displayed on the Google search engine.
It’s evident that they were aware of the trademarked nature of Kinkassage. This is indicated by their deliberate insertion of a hyphen, “Kink-assage” — attempting to imitate my distinctive Kinkassage® wording.

In 2014, I secured the Kinkassage® trademark in the United States. However, I faced initial challenges when attempting to register it in Australia. Confronted with difficulties during the Australian registration process, I enlisted the help of a U.S. trademark attorney.
My trademark attorney was successful and Kinkassage® became a U.S. trademark. This strategic decision proved instrumental, leading to the eventual and successful registration of Kinkassage® in Australia.

Rather than showcasing innovation and originality, my copycat revealled themselves as an opportunists. An individual who lacks the vision to develop their own unique business branding, ideas and concepts.
So sad, that they can’t muster the creativity to birth their own business branding ideas. Therefore this person, chose a shortcut of duplicating my effort and the ten years of building my Kinkassage® brand.

Copying any person’s registered trademark really reflects poorly on an individuals character. It also undermines the integrity of the adult industry business landscape. It signals a willingness to compromise on authenticity.
Basically, this deceptive business practice is done to ride on the coat-tails of my successful business branding. Moreover, the act of copying a trademark suggests a certain desperation on the part of my copycat.
It is time for them to put on their own creative cap on and develop their own bodywork modality. A bodywork modality that stands on its own merit. Something unique that can stand out in the adult sex industry.
